Terms of Service

1. The service

PRIMEX ("the Service") is an AI-powered study tool for postgraduate medical specialist examinations and for medical-student clinical assessments. It is operated by PRIMEX Study ABN 41 535 231 642. The Service is not affiliated with, endorsed by, or connected to ANZCA, CICM, ACEM, RACP, RACS, RACGP, ACRRM, RANZCOG, RANZCP, RANZCR, RCPA, AOA, the Australian Medical Council, or any other examining body, medical college, university, hospital, or training authority. Any college, examination, or specialty names used on the Service are used in their ordinary descriptive sense to identify the exam for which our study material is intended.

2. Not medical or exam advice

Content generated by PRIMEX is for educational and study purposes only. AI-generated answers, grades, and feedback are approximations and should not be treated as official examiner opinions, marking guides, or guarantees of exam performance. Results are not guaranteed. Always refer to the official curriculum, syllabus, and published marking criteria of your examining body.

3. Accounts and access

You must provide a valid email address to create an account. You are responsible for keeping your login credentials secure. One account is for one person; sharing access codes or credentials is not permitted.

4. Subscriptions and billing

Card required at signup. All paid plans include a 7-day free trial. To start a trial you provide a valid payment method through Stripe. You will not be charged during the 7-day trial. If you do not cancel before the trial ends, your card will be charged the price of the plan you selected on day 7 and your paid subscription will begin.

Auto-renewal. Paid plans renew automatically at the end of each billing period (monthly, every 3 months, or annually depending on the plan you selected) at the then-current price for the same plan length, unless you cancel before that period ends. The price you pay, the billing period, and the next renewal date are shown on the Stripe checkout page before you pay and on your Account page at any time after you subscribe.

Cancellation. You can cancel at any time from your Account settings or from the Stripe customer portal link in your subscription email. Cancellation takes effect at the end of your current billing period; you retain access until then and you will not be charged again. Cancelling during the 7-day trial stops the trial and prevents any charge.

Price changes. We will give you at least 14 days' notice by email before any change to your renewal price. You can cancel during that notice period to avoid the new price.

Refunds. Cancelling stops future charges; we do not generally refund a billing period already paid. If you were charged in error (for example, after you cancelled, or due to a technical failure) email us and we will refund the charge in full. This clause does not limit any non-excludable rights you have under the Australian Consumer Law, including consumer guarantees that the Service will be of acceptable quality, fit for purpose, and supplied with due care and skill.

5. Your content

Answers you write and data you enter remain yours, and we do not sell your data. When you post a comment in a question discussion or a message in a study group, you keep ownership of that content but grant PRIMEX a licence to display it to other users as part of the community features. In study groups your posts are visible to members of your group; in question discussions they are visible to other users preparing for the same exam, under your display handle or anonymously. You are responsible for what you post and must follow the acceptable-use rules in clause 7. Anything you save to your personal saved-answers library stays on the device you saved it from. You can leave a study group, and ask us to remove community content you have posted, at any time.

6. Intellectual property

All content made available through the Service - including study notes, flashcards, question libraries, AI-generated feedback, curriculum mappings, and any other materials - is the intellectual property of PRIMEX Study ABN 41 535 231 642 and is protected by Australian copyright law. Your subscription grants you a personal, non-transferable licence to access this content for your own private study. You must not copy, reproduce, screenshot, download, republish, distribute, resell, or make publicly available any content from the Service, in whole or in part, by any means. Extracting or systematically collecting content (whether manually or by automated means) is prohibited. Breach of this clause may result in immediate account termination and legal action.

6a. Trade marks

PRIMEX™ is a trade mark of PRIMEX Study (ABN 41 535 231 642). An application for registration is pending before IP Australia (application no. 2647604, filed 26 April 2026, classes 9 and 41). Use of the PRIMEX™ name, logo, or any confusingly similar mark in connection with educational, software, or related goods or services without prior written permission is prohibited. Nothing on the Service grants you any licence to use the PRIMEX™ mark.

7. Acceptable use

Do not use the Service to share exam content that is under copyright or NDA, misrepresent AI-generated content as your own in formal assessments, or attempt to reverse-engineer, scrape, or redistribute the Service.

No patient or clinical information. You must not enter, paste, upload, or otherwise submit any information that identifies (or could reasonably be used to identify) a patient or other individual into PRIMEX. This includes names, dates of birth, medical record numbers, addresses, hospital identifiers, photographs, scans, pathology results, or any other clinical record. PRIMEX is a study tool; it is not a clinical record system, and submitted content is processed by third-party AI providers. If you wish to discuss a real case, fully de-identify it first by removing all of the elements above and altering non-essential clinical detail. We may suspend or terminate accounts that submit identifiable patient information.

8. Availability and changes

We aim to keep the Service available but do not guarantee uptime. We may update features, pricing, or these terms. Material changes to pricing or terms will be communicated by email with at least 14 days' notice.

9. Limitation of liability

The Service is provided "as is". To the maximum extent permitted by Australian law, PRIMEX Study is not liable for any indirect, incidental, or consequential damages arising from use of the Service, including exam outcomes. Nothing in these terms excludes any non-excludable consumer guarantees under the Australian Consumer Law.

10. Indemnity

You agree to indemnify and hold harmless PRIMEX Study ABN 41 535 231 642, its directors, employees, and contractors from and against any claim, loss, liability, or expense (including reasonable legal costs) arising from: (a) your breach of these terms; (b) your misuse of the Service, including any submission of identifiable patient or clinical information in breach of clause 7; (c) any content you submit, share, or upload to the Service that infringes a third party's rights; or (d) your violation of any applicable law. This indemnity does not apply to the extent the claim arises from PRIMEX's negligence or wilful misconduct, and nothing in this clause limits your rights under any non-excludable consumer guarantee under the Australian Consumer Law.

11. Governing law

These terms are governed by the laws of New South Wales, Australia.
